Family Visas: Applying When You Cannot Meet the Financial or English Language Rules

Navigating UK immigration rules can be incredibly stressful, especially when it feels like a strict requirement stands between you and your family’s future in the UK. If you are applying for Further Leave to Remain as a partner or family member but cannot meet the minimum income threshold or pass the English language test, you still have options.

The Home Office recognises that strict rules cannot account for every human situation. Under UK human rights law (Article 8 of the European Convention on Human Rights), you have a right to respect for your private and family life. If refusing your visa would breach these rights, you may be eligible to remain in the UK on what is known as the 10-Year Family Route.

At Immigration Street Legal, our immigration specialists excel in handling complex, discretionary applications. We are here to help you build a compelling case that protects your family from separation.

What is the 10-Year Route to Settlement?

Standard spouse and family visas typically put you on a 5-year path to Indefinite Leave to Remain (ILR). However, if you cannot meet the strict financial or English language requirements, but you do meet the requirements for an "exception" based on your human rights, the Home Office will grant your visa on a 10-year route.

You will still be granted leave to remain for 30 months (2.5 years) at a time, and you will have the right to work and live in the UK. The primary difference is that you must complete four continuous grants of this visa (10 years total) before you can apply for permanent settlement.

(Note: If your circumstances change in the future—for instance, your income increases or you pass the English test—you can often apply to switch back to the 5-year route).

How to Qualify: The "Exceptions"

To succeed in an application where you fall short of the standard rules, we must prove to the Home Office that one of the following legal exceptions applies to your case:

1. Insurmountable Obstacles to Living Abroad (Paragraph EX.1)

We must demonstrate that there are "insurmountable obstacles" preventing you and your British or settled partner from living together in your home country.

  • What this means: The Home Office defines this as very significant difficulties that would be impossible to overcome, or that would entail very serious hardship for you or your partner.

  • Examples: This could include a lack of vital medical treatment in your home country, severe cultural or religious persecution, or a situation where your partner is completely unable to learn your native language or find employment there due to severe barriers.

2. The Best Interests of a Child

The Home Office has a legal duty to safeguard and promote the welfare of children in the UK. You may qualify for an exception if you have a "qualifying child" and it would be unreasonable to expect them to leave the UK.

  • What is a qualifying child? A child who is under 18, lives in the UK, and is either a British citizen or has lived in the UK continuously for at least 7 years.

  • What this means: If uprooting your child would cause severe disruption to their education, health, or wellbeing, this forms a very powerful basis for your application to remain.

3. Exceptional Circumstances and Unjustifiably Harsh Consequences

Even if your situation does not perfectly fit the definitions of "insurmountable obstacles" or a "qualifying child," the Home Office must still consider whether refusing your visa would lead to unjustifiably harsh consequences for you, your partner, or a relevant child. We will help you compile detailed evidence of the severe emotional, financial, or physical impact a refusal would have on your family unit.

Why Choose Immigration Street Legal?

Applications relying on human rights exceptions are highly discretionary. The Home Office will not automatically grant your visa just because you ask for compassion; they require a meticulously prepared bundle of evidence and robust legal arguments linking your personal circumstances directly to UK case law.

When you instruct our specialised family immigration team, we will:

  • Listen to your story: We conduct a deep-dive consultation to uncover every detail of your family’s life, health, finances, and background to find the strongest legal arguments.

  • Gather targeted evidence: We advise you on obtaining specialised evidence, such as independent medical reports, psychological assessments, or educational reports for your children, which are crucial for proving "harsh consequences."

  • Draft compelling legal representations: We write a comprehensive legal cover letter to the Home Office, presenting your case clearly and referencing the latest human rights laws and tribunal decisions.

  • Support you completely: We handle all correspondence with UK Visas and Immigration (UKVI) so you can focus on being with your family.
