Continue Your Life Together: Spouse Visa Extensions

Reaching the end of your first two and a half years on a Spouse or Partner Visa is an exciting milestone—you are now halfway to your ultimate goal of settlement (Indefinite Leave to Remain).

To continue living and working in the UK, you must apply for a Spouse Visa Extension (also known as Further Leave to Remain on the family route) before your current visa expires. A successful application will grant you a further 30 months of leave.

At Immigration Street Legal, we know that gathering two and a half years' worth of paperwork can feel overwhelming. Our family immigration team is here to take the stress out of the renewal process, ensuring your application is meticulously prepared so you can focus on your future together.

When Should You Apply?

Timing is critical for an extension application. You must submit your application before your current visa expires. However, if you apply too early, you may not accrue the full 5 years required for Indefinite Leave to Remain, leading to the need for a costly third extension.

We generally advise applying within the 28 days before your current visa expires, or within 28 days of reaching exactly 30 months in the UK on your current visa.

Key Requirements for a Spouse Visa Extension

To secure your further 30 months, the Home Office requires you to prove that you continue to meet the rules of the family route. The requirements are similar to your first application, but with a few crucial updates:

1. Proof of Cohabitation (Living Together)

This is often the most challenging part of an extension application. You must prove that your relationship is genuine and subsisting, and that you have lived together continuously in the UK since your last visa was granted.

  • The Correspondence Rule: The Home Office expects to see at least 6 pieces of joint correspondence (or 12 individual items, or a mix) addressed to you and your partner at the same address.

  • These documents must span the last 2 to 2.5 years and come from at least 3 different official sources (e.g., council tax bills, utility bills, bank statements).

2. The Financial Requirement

You must continue to prove that you can support yourselves financially.

  • Important Note on Income Rules: The Home Office recently increased the minimum income threshold. However, if your initial Spouse Visa was granted before 11 April 2024, you benefit from "transitional arrangements" and will likely still be assessed under the old £18,600 threshold. If your first visa was granted after this date, the new £29,000 threshold applies.

  • Because these rules are highly complex, we strongly recommend allowing us to assess your current financial situation, whether you are relying on employment, self-employment, or cash savings.

3. Adequate Accommodation

You must show that you continue to have suitable living arrangements in the UK for yourselves and any dependents, without relying on public funds.

4. An Updated English Language Test

If you took an A1 level English test for your first Spouse Visa, you cannot use it again. For your extension, you must pass an approved speaking and listening test at level A2 or higher (unless you hold a degree taught in English or are exempt due to age or medical conditions).

Why Choose Immigration Street Legal?

The Home Office is incredibly strict regarding the format and dates of the documents used for Spouse Visa extensions. Missing a few months of bank statements or failing to provide the right mix of cohabitation evidence can lead to delays or even a refusal.

When you instruct our team, we will:

  • Provide a tailored, exact checklist of the cohabitation documents you need to cover the last two and a half years.

  • Calculate your application date to ensure you don't apply too early or become an overstayer.

  • Review your financial evidence to ensure it meets the complex transitional rules.

  • Draft detailed legal representations and manage all communications with UK Visas and Immigration (UKVI).
