10-Year Long Residence ILR: Settling in the UK
Building a life in the UK takes time, and the Home Office recognizes the commitment of those who have laid deep roots over a decade. If you have lived in the UK continuously and lawfully for 10 years, you may be eligible to apply for Indefinite Leave to Remain (ILR) under the Long Residence route.
This route is highly versatile, allowing you to combine time spent on various visas—such as Student, Skilled Worker, or Family visas—to reach the 10-year milestone. However, the rules governing continuous residence and permitted absences have recently become much more complex, with significant changes introduced in April 2024.
Below is a comprehensive overview of the requirements and how our firm can help you secure your settlement.
Qualifying Requirements for 10-Year Long Residence
To successfully apply for ILR under this route, you must demonstrate to UK Visas and Immigration (UKVI) that you meet several strict criteria:
10 Years Lawful Residence: You must have completed a qualifying period of 10 years' continuous and lawful residence in the UK. Time spent on certain visas, such as a Visitor, Short-term Student, or Seasonal Worker visa, does not count towards this period.
Current Visa Duration: A crucial new rule states that you must have held permission on your current visa route for at least 12 months before the date of application, unless an exception applies or you were exempt from immigration control.
No Immigration Breaches: You must not be in the UK in breach of immigration laws, and you cannot be on immigration bail at the time you apply.
Suitability Criteria: Your application must not fall for refusal under general grounds, meaning you must not have a serious criminal history or other public policy concerns.
Life in the UK & English Language: You must pass the Life in the UK Test and meet the English language requirement (at least B1 CEFR level), unless you are exempt due to your age or a medical condition.
Physical Presence: You must be in the UK on the date of your application.
Navigating the Complex Rules on Absences
The most heavily scrutinized aspect of a 10-year Long Residence application is ensuring you have not broken your "continuous residence" by spending too much time outside the UK. The Home Office reformed these rules on April 11, 2024, meaning two different sets of absence rules will likely apply to your timeline, depending on when your travel occurred.
Absences Before April 11, 2024 (The Old Rules) For any trips outside the UK that commenced before April 11, 2024, the previous limits apply:
No single absence could be longer than 184 days (6 months).
The total number of days spent outside the UK during the relevant qualifying period must not exceed 548 days (18 months).
Absences On or After April 11, 2024 (The New Rules) For absences beginning on or after this date, the rules shifted entirely:
There is no longer a 548-day total cap.
Instead, you must not be outside the UK for more than 180 days in any rolling 12-month period.
It is essential to meticulously document every trip outside the UK—including the exact dates of departure and return—so each absence can be accurately assessed against the correct rule.
Timing Your Application
You can submit your application for ILR up to 28 days before you officially complete your 10-year qualifying period. Calculating this date correctly is critical. If you apply too early (more than 28 days in advance), your application will be automatically refused by the Home Office, resulting in lost fees and potential complications with your status.
