Become a British Citizen: Naturalisation Applications

Applying for British Citizenship is the ultimate milestone in your UK immigration journey. It is the final step that grants you the right to hold a British passport, vote in all UK elections, and live free from any immigration restrictions for the rest of your life. However, applications to become British are being subjected to increased scrutiny. The good character requirements are being interpreted increasingly strictly, and there is no right of appeal if your application is refused for any reason.

At Immigration Street Legal, we have extensive experience with British Citizenship applications. We understand how important this moment is for you and your family. After years of navigating visas and immigration rules, you want to ensure your final application is completely stress-free and successful. Our expert team is here to manage the entire naturalisation process, allowing you to look forward to your citizenship ceremony with complete peace of mind.

Are You Eligible to Apply?

The rules for Naturalisation (officially known as becoming a citizen under the British Nationality Act 1981) depend on your relationship status with a British citizen.

There are two main pathways:

1. The Standard Route (5-Year Route)

If you are not married to or in a civil partnership with a British citizen, you can typically apply if:

  • You have lived in the UK for at least 5 years.

  • You have held Indefinite Leave to Remain (ILR), EU Settled Status, or permanent residence for at least 12 months.

2. The Spouse or Civil Partner Route (3-Year Route)

If you are married to or in a civil partnership with a British citizen, the rules are more relaxed. You can apply if:

  • You have lived in the UK for at least 3 years.

  • You hold ILR or EU Settled Status (you do not need to wait 12 months after receiving it; you can apply immediately).

Key Requirements for British Citizenship

Whichever route you take, the Home Office will scrutinise your application against several strict criteria. A simple oversight in any of these areas can lead to a refusal and the loss of your application fee.

1. Strict Limits on Absences (Time Outside the UK)

The Home Office expects you to have made the UK your main home, which means there are strict limits on how many days you can spend abroad:

  • Standard Route: No more than 450 days outside the UK in the 5-year qualifying period, and no more than 90 days in the final 12 months.

  • Spouse Route: No more than 270 days outside the UK in the 3-year qualifying period, and no more than 90 days in the final 12 months.

  • Note: If you have exceeded these limits, the Home Office has some discretion to forgive excess absences, depending on the reasons. We highly recommend booking a consultation with us to review your travel history before you apply.

2. The "Good Character" Requirement

To become a British citizen, you must be of "good character." The Home Office will conduct thorough background checks. They will look for any criminal convictions (including driving offences), civil judgments, bankruptcy, tax issues with HMRC, or past breaches of immigration law.

3. Knowledge of Language and Life in the UK

Unless you are exempt due to age (under 18 or over 65) or a long-term medical condition, you must prove your integration into UK society:

  • The Life in the UK Test: You must pass this multiple-choice exam (even if you already passed it for your ILR application, your previous pass certificate remains valid).

  • English Language Requirement: You must demonstrate English speaking and listening skills to at least level B1 (or hold a degree taught in English).
